The Supreme Court's conservative majority appeared skeptical of a charge federal prosecutors have lodged against hundreds of people who attacked the US Capitol on January 6, 2021. While the court’s three-justice liberal wing signaled support for the charge, the conservative majority raised a series of skeptical questions about its potential scope and whether it would criminalize other conduct, such as protests. The charge can tack up to 20 years onto a prison sentence. Joseph Fischer, a former Pennsylvania police officer and January 6 defendant who brought the case to the Supreme Court, argued that the law at issue, created in response to the Enron scandal in 2001, was intended to stop witness tampering, not riots. During more than an hour and a half of arguments, Chief Justice John Roberts and Justices Brett Kavanaugh, Neil Gorsuch and Samuel Alito were among those who appeared to take issue with the government’s reading of the law.

The New Hampshire Republican presidential primary is just two days away, and representatives for the major candidates were busy Sunday with TV appearances and campaign events. When asked whether DeSantis canceled his appearances on the Sunday shows because he did not want to talk about his “dire” poll numbers, Massie focused his attention on former South Carolina Gov. Nikki Haley, who stands with 39% support among likely Republican primary voters in New Hampshire to Donald Trump's 50%. The state's governor, Henry McMaster, has also endorsed the former president, as has Sen. Lindsey Graham. As for the upcoming contest in New Hampshire, a state that allows independents to participate in the primary process, Vance accused some of those voters of being “liberals” who moved to New Hampshire from Massachusetts and insinuated Haley’s campaign strategy is “getting liberals to vote for you in a Republican primary,” adding “it doesn’t work nationally.”

CNN —Former first lady Rosalynn Carter has entered hospice care at home in Plains, Georgia, the Carter Center announced Friday. CNN —A jury has found David DePape guilty on two counts in the violent attack on Paul Pelosi, the husband of former House Speaker Nancy Pelosi, last year in the couple’s San Francisco home. Then-House Speaker Nancy Pelosi ultimately factored the attack into her decision to step down from her leadership post. DePape recalled that he was focused on Nancy Pelosi and that her husband, Paul, was not on his list of targets. He later came to in a pool of blood after being violently struck in the head following a struggle with DePape, Pelosi said. A state case against DePape that includes charges of attempted murder, burglary and assault is expected to go to trial later this month.

CNN —When US Secretary of State Antony Blinken lamented the civilian death toll in Gaza on Friday, it marked a subtle but notable shift in US language toward the Israeli government. Administration officials argue they have had success in some areas as they work to alleviate the humanitarian crisis in Gaza. The White House said Thursday that Israel had agreed to move forward with daily four-hour pauses of military operations in areas of Northern Gaza. That’s a rise from 32% saying Israel should negotiate while fighting when the survey was last conducted about two weeks earlier. CNN —Former President Donald Trump holds an edge over President Joe Biden in a series of hypothetical matchups among registered voters in four key swing states, new polling from The New York Times and Siena College shows. In Nevada, a state Biden narrowly carried in the 2020 presidential election, Trump boasts 52% support to Biden’s 41%. Trump also tops Biden in Georgia, a state that was central to his ploy to overturn the last presidential election, with 49% to Biden’s 43%. Trump leads Biden in Arizona, too, with 49% to the president’s 44%. In Pennsylvania, a state Trump won in 2016 but Biden recaptured in 2020, Trump is at 48% to Biden’s 44%.

CNN —Former Vice President Mike Pence on Sunday intensified his attacks on his former boss, hitting former President Donald Trump over everything from his abortion messaging to comments about the war in Ukraine. “When Donald Trump ran for president in 2016, he promised to govern as a conservative. And he wants to marginalize the right to life,” Pence said. The comments from Pence represent a significant escalation in his campaign attacks on Trump. More than 4 in 10 in the potential GOP primary electorate say they have definitely decided to support Trump for the nomination (43% are definite Trump backers, 20% are firmly behind another candidate, and 37% have no first choice or say they could change their minds).

CNNHouse Judiciary Chair Jim Jordan on Sunday fiercely defended Donald Trump against his federal indictment, repeatedly claiming that the former president had the ability to declassify documents at any time. But Jordan repeatedly countered that saying he “could have” declassified material as president was not the same as saying he “didn’t” already declassify the material. “He has said time and time again, he's declassified all this material,” Jordan said. Trump is facing his first federal indictment for retention of classified documents and conspiracy with a top aide to hide them from the government and his own attorneys — a total of 37 counts. According to the indictment, classified documents were allegedly kept at various places in Trump's Mar-a-Lago resort, including a public ballroom, bathroom and bedroom.

OPEC+ was formed in 2016 to coordinate and regulate oil production and stabilize global oil prices. What it means for Putin: OPEC+’s decision to cut oil production could have big implications for Russia. After Russia invaded Ukraine last year, the United States and United Kingdom immediately stopped purchasing oil from the country. Higher-priced oil could help Russia pay for its war on Ukraine and also boosts revenue in Saudi Arabia. CNN —Special counsel Jack Smith has subpoenaed Georgia Secretary of State Brad Raffensperger as part of the Justice Department’s investigation into efforts to overturn the 2020 election and the US Capitol attack on January 6, 2021. Mike Hassinger, public information officer with the Georgia secretary of state’s office, confirmed that Raffensperger’s office has received a subpoena from Smith. “At the request of the Justice Department, we have no further comment,” Hassinger said in an email to CNN. Smith has also issued a flurry of subpoenas, including to election officials in battleground states where Trump tried to overturn his loss in 2020. And there’s nothing wrong with saying that, you know, um, that you’ve recalculated,” Trump said in one part of the call.

Washington CNN —Sen. Bernie Sanders of Vermont said Sunday that “political aspirations” drove Sen. Kyrsten Sinema’s exit from the Democratic Party, as he vowed to take a “hard look” at supporting a potential Democratic challenge to her in Arizona. I happen to suspect that it’s probably a lot to do with politics back in Arizona. Sinema announced last week she was leaving the Democratic Party and registering as a political independent, a move that is unlikely to change the power balance in the next Senate. Democrats will have a narrow 51-49 majority that includes two independents who caucus with them: Sanders and Angus King of Maine. She also brushed aside criticism she may face for the decision to leave the Democratic Party.

Washington CNN —The House select committee investigating the January 6, 2021, insurrection concluded its meeting on Sunday where members discussed criminal referrals, multiple sources told CNN. The subcommittee tasked with investigating criminal referrals presented its recommendations to the full panel at a 1 p.m. ET virtual meeting, but it is unclear if those recommendations were officially adopted. Committee Chair Bennie Thompson, a Mississippi Democrat, told reporters Friday he expected to reach a decision on criminal referrals at Sunday’s virtual meeting. But Schiff reiterated on Sunday that the committee will wait to announce its decision until December 21, when it plans to present the rest of its report.

The United States and European Union established the council in June last year as a forum for discussing new technology and trade. “With the Inflation Reduction Act being informally discussed only over a 45-minute lunch, the commissioner has decided not to participate,” the aide added. The Inflation Reduction Act has become an acute source of tension between the allies. Asked on Saturday what he thought of Musk purchasing Twitter and his own future on the platform, Trump praised Musk but questioned whether the site would survive its current crises. New York CNN Business —Newly minted Twitter owner Elon Musk said Friday afternoon that the social media company “will be forming a content moderation council with widely diverse viewpoints.” That means suspended accounts like the one held by former President Donald Trump won’t immediately return to Twitter. “No major content decisions or account reinstatements will happen before that council convenes,” Musk added. Musk has repeatedly stressed his intention to rethink Twitter (TWTR)’s content moderation policies, as well. Musk had previously indicated that he was not a supporter of permanently banishing people from Twitter and that Trump would be permitted to return under his ownership. Musk’s commitment to a moderation council should pause some of those concerns for now.
